E-Discovery: What Do You Find Most Frustrating?

(Inside Counsel, 9 February 2012)

In Brief:
A survey of in-house lawyers found that 94% see the cost of e-discovery as “frustrating” and 39% are unable to quantify how much they spend on e-discovery.

Our View: The daunting volume of electronic data stored by companies creates unprecedented liabilities and potential discovery costs across all operating jurisdictions. As a result, corporate legal departments must fully understand each jurisdiction’s rules and work to implement cost-effective mechanisms to reduce the burden on their legal budgets. Leading best practices from our membership include establishing a centralized location where Legal stores data collected during discovery and delegating e-discovery responsibilities to internal parties.
